1. About these terms
These Terms of Service ("Terms") are an agreement between you and FamilyPine LLC ("FamilyPine", "we", "us"). They cover the FamilyPine apps for iPhone, iPad and Android, the website at familypine.com and any related services (together, the "Service").
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy, which explains how we handle personal information. If you don't agree, please don't use the Service.
If you use FamilyPine on behalf of someone else, such as a child whose profile you manage, you accept these Terms for them as well.
2. Who can use FamilyPine
- You must be at least 13 years old to create an account, or older if the law where you live sets a higher age for using online services without a parent's consent.
- If you are under 18 (or the age of majority where you live), a parent or legal guardian must agree to these Terms for you.
- Younger children can take part in a family only through a dependent profile created and managed by a parent or guardian. A dependent profile has no login, email address or phone number of its own, and the managing adult is responsible for what is shared about the child.
- You can't use the Service if we have previously closed your account for breaking these Terms, or if the law prohibits you from using it.
3. Your account
- You sign in with your email address and a one-time code we send to it. Keep access to that email account secure, because anyone who can read it can sign in as you.
- Give us accurate information and keep your email address up to date.
- You are responsible for activity on your account. Tell us right away at support@familypine.com if you think someone else has used it.
- One account is for one person. Don't share it, sell it or transfer it.
4. Families, members and roles
FamilyPine is organised around private families. Nobody can find or join a family without an invitation.
- Invitations. Only invite people you know and who would expect to hear from you. Each family's plan limits how many members it can have.
- Belonging to several families. You can belong to more than one family. You choose which family or families can see each memory you share.
- Family administrators. Some members can manage a family, for example by inviting or removing members, changing family settings or managing the family's plan. Administrators must use these tools fairly and in good faith.
- Leaving or being removed. You can leave a family at any time. When you leave or are removed, you lose access to that family's content, but what you posted there may stay visible to the family unless you delete it first.
- The family tree. Relationships you add are shown to other members from each person's point of view. Only add relatives you have a genuine connection to, and add details about other people only when you have a right to share them.
- Memorial profiles. You may create a memorial profile for a relative who has passed away. Please do so respectfully and, where possible, with the agreement of close family.
5. Your content
"Your content" means anything you add to FamilyPine: photos, videos, voice messages, posts, comments, messages, life events, family tree details, documents in the Family Vault and other information.
- You own your content. We don't claim ownership of anything you upload.
- Permission you give us. So that we can run the Service, you give us a worldwide, non-exclusive, royalty-free licence to store, copy, process, resize, compress, back up and display your content, only to show it to the people you choose and to provide, secure and improve the Service. This licence ends when your content is deleted from our systems, except for copies we must keep by law or that remain for a short time in backups.
- We don't sell or advertise with your content. We don't sell your content, use it for advertising, or make it public.
- Your responsibility. Only share content you have the right to share. When content shows or describes other people, especially children, make sure sharing it with the family is appropriate and that you have their consent (or their parent's or guardian's consent) where the law requires it.
- Shared memories. When other members add photos to a memory you started, each person keeps ownership of what they added.
- Keep your own copies. We work hard to protect your content, but FamilyPine is not a guaranteed backup service. Keep copies of anything irreplaceable.
6. The Family Vault
The Family Vault is available on paid plans. Files are encrypted on your device before they're uploaded, so we only store encrypted data and can't read your documents.
- The vault is unlocked with a vault password, and your 24 recovery words are the backup key. We never receive your recovery words.
- Because we can't see your password or recovery words, we can't reset them. If you lose both, the files in the vault can't be recovered by you or by us.
- Anyone who has your vault password or recovery words can open the vault. Keep them private and offline.
- The vault is a convenient place to keep copies of documents. It doesn't replace original documents or official records.
7. Location alerts
- Location alerts are available on paid plans. An alert tells the person who created it when a family member arrives at a place, or hasn't arrived by a set time.
- A member's location is only used while an alert that involves them is being checked, and only if they have allowed location access on their device. Members can turn off location access at any time in their device settings.
- Only set alerts for people who know about them and have agreed, or for children in your care. Never use FamilyPine to secretly track, monitor or follow anyone.
- Location alerts are not an emergency or safety service. They depend on the phone, its settings, GPS, battery and network, and alerts can be late, inaccurate or missing. Don't rely on them where someone's safety is at stake, and always contact emergency services in an emergency.
8. Messages and calls
- You can message and voice call members of your families on any plan. Video calls are included with paid plans.
- FamilyPine calls are not a replacement for your phone. You can't use FamilyPine to call emergency services.
- Calls and messages use your internet connection, and your mobile carrier may charge for data.
9. Acceptable use
FamilyPine is a place for families. When you use it, you must not:
- share content that is illegal, hateful, harassing, threatening, sexually explicit or violent, or that encourages self-harm;
- bully, stalk, intimidate or abuse anyone, including other members of your family;
- share someone's private information, photos or documents without the right to do so;
- impersonate someone, or misrepresent your relationship to someone;
- infringe anyone's copyright, trademark, privacy or other rights;
- send spam, advertising or chain messages, or invite people in bulk who don't know you;
- upload viruses or malicious code, or try to get into accounts, families or systems you don't have permission to access;
- scrape, copy, reverse engineer or interfere with the Service, or get around limits or security features, except where the law allows it;
- use the Service for any commercial purpose or for anyone other than you and your family without our written permission.
10. Child safety
We have zero tolerance for any content or behaviour that sexually exploits, abuses or endangers children. This includes child sexual abuse material, grooming, sexualised content involving minors and sextortion.
- We remove such content, permanently close the accounts involved, and report it to the National Center for Missing & Exploited Children (NCMEC) and to law enforcement where required or appropriate.
- If you see anything that puts a child at risk, report it to support@familypine.com. If a child is in immediate danger, contact your local emergency services first.
11. Reporting and enforcement
- FamilyPine families are private, and we don't routinely monitor what families share. Report content or behaviour that breaks these Terms to support@familypine.com.
- If we believe you have broken these Terms or the law, or put others at risk, we may remove content, limit features, or suspend or close your account. Where it's appropriate and safe, we'll tell you why and give you a chance to respond.
- If you think we made a mistake, contact us and we'll review the decision.
12. Plans, payments and renewals
Plans belong to a family, not to a person. FamilyPine offers a Free plan and the paid Pioneer, Legacy and Heritage plans, billed monthly or yearly. Current prices and what each plan includes are shown in the app and on our plans page. Paid plans don't include a free trial.
- Who pays. One family member pays for the family's plan, and every member of that family gets its features. Each family you belong to has its own plan.
- How you pay. On iPhone and iPad, subscriptions are purchased through the Apple App Store. Elsewhere, payments are processed by Stripe. Your purchase is also subject to the terms of the store or payment provider you use, and we never see or store your full card details.
- Automatic renewal. Paid plans renew automatically at the end of each monthly or yearly billing period, at the price shown when they renew, until you cancel. You can cancel at any time; your plan stays active until the end of the period you've paid for.
- How to cancel. For App Store subscriptions, cancel in your Apple account's subscription settings. For other subscriptions, cancel from the family's Membership page in the app.
- Changing plans. Moving to a higher-priced plan takes effect right away and you're charged the prorated difference. Moving to a lower-priced plan takes effect at the end of the current billing period.
- Member limits. If a family has more members than its plan allows (for example after a downgrade), current members stay, but new invitations can't be accepted until the family is within its limit or upgrades.
- When a paid plan ends. The family moves to the Free plan. Paid features stop working. Files already in the Family Vault are kept read-only, so you can still view, download and delete them. Files in the vault's Trash are permanently deleted 30 days after the plan changes to Free.
- If the payer leaves. The plan keeps running until it is cancelled or another member takes over payment by upgrading.
- Refunds. Payments are non-refundable except where the law requires otherwise. Refunds for App Store purchases are handled by Apple under its policies.
- Price changes. We may change prices. We'll tell you before a new price applies to your plan, and you can cancel before it takes effect.
- Taxes. Prices may include or be subject to taxes, depending on where you live.
13. Deleting your account
- You can permanently delete your account and data at any time from your profile in the app, or by emailing support@familypine.com.
- Deletion can't be undone. Download anything you want to keep first.
- If you pay for a family's plan, cancel the subscription before deleting your account. App Store subscriptions must be cancelled with Apple.
- Our Privacy Policy explains what happens to your data when you delete your account.
- We may close accounts that break these Terms, as described above, or discontinue the Service. If we discontinue the Service, we'll give you reasonable notice and a chance to download your content where we can.
14. FamilyPine's rights
The FamilyPine name, logo, apps, website and designs belong to us or our licensors and are protected by law. These Terms give you a personal, non-exclusive, non-transferable, revocable licence to use the apps for your own family use. They don't give you any right to use our name or branding.
If you send us ideas or feedback, we may use them without any obligation to you.
15. Third-party services
The Service relies on other providers, such as app stores, payment processors, mapping and place search, push notifications and calling infrastructure. Your use of their features may also be covered by their terms. We aren't responsible for third-party services, websites or content that we don't control.
16. Changes to the Service and to these Terms
- We're always improving FamilyPine, so features may be added, changed or removed.
- We may update these Terms from time to time. If a change is significant, we'll let you know in the app or by email before it takes effect. The date at the top shows when these Terms last changed.
- If you keep using the Service after a change takes effect, the new Terms apply. If you don't agree with them, you can stop using the Service and delete your account.
17. Disclaimers
We work hard to keep FamilyPine available, secure and reliable, but we can't promise it will always be uninterrupted, error-free or free of data loss. To the extent the law allows, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
Nothing in these Terms limits rights you have under consumer protection laws that can't be waived.
18. Limitation of liability
To the extent the law allows, FamilyPine and its owners, employees and suppliers won't be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, goodwill or opportunity, arising from or related to the Service or these Terms.
To the extent the law allows, our total liability for all claims related to the Service is limited to the greater of (a) the amount you paid us for the Service in the 12 months before the claim arose, or (b) 50 US dollars.
These limits don't apply to liability that can't be limited by law, such as liability for death or personal injury caused by negligence, or for fraud.
19. Indemnity
To the extent the law allows, you agree to cover FamilyPine against claims, losses and costs (including reasonable legal fees) that arise from content you share in breach of these Terms, from your misuse of the Service, or from your breaking the law or someone else's rights.
20. Governing law and disputes
Before starting any formal dispute, please contact us at support@familypine.com so we can try to resolve it informally.
These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law rules. Any dispute will be heard in the state or federal courts located in Los Angeles County, California, and you and FamilyPine agree to the jurisdiction of those courts. If you live in the United Kingdom, the European Union or another country whose consumer laws give you the right to bring claims in your local courts or under your local law, you keep that right.
21. General
- These Terms and our Privacy Policy are the whole agreement between you and FamilyPine about the Service.
- If any part of these Terms can't be enforced, the rest stays in effect.
- If we don't enforce a part of these Terms straight away, we can still enforce it later.
- You can't transfer your rights under these Terms to anyone else. We may transfer ours as part of a merger, acquisition or sale of assets, and we'll tell you if that happens.
- FamilyPine is available in several languages. If a translation of these Terms differs from the English version, the English version applies, unless the law where you live says otherwise.
